Lenovo ThinkPad X1 Carbon Sweepstake: Official Rules

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. MAKING A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.  INTERNET AND X ACCESS ARE REQUIRED TO PARTICIPATE IN THIS SWEEPSTAKES.  STANDARD MESSAGE AND DATA RATES MAY APPLY IF ENTERING VIA A MOBILE DEVICE.

Entry into the Lenovo ThinkPad X1 Carbon Sweepstakes (the “Sweepstakes”) constitutes your acceptance of these Official Rules. 

1. ENTRY PERIOD: This Sweepstakes entry period begins October 1, 2024 at 5:00 am Eastern Time (“ET”) and ends December 31, 2024 at 11:59 pm ET (“Entry Period”).  The Sweepstakes runs from the first day of the Entry Period until the winners have been selected and notified (“Promotion Period”).
    
2. WHO MAY ENTER: Sweepstakes is only open to legal residents of the fifty (50) United States and the District of Columbia (“Territory”) who are age 18 years or older and have reached the age of legal majority in their jurisdiction of residence, and who have a valid X account at time of entry through the end of the Promotion Period.  THIS SWEEPSTAKES IS VOID OUTSIDE THE TERRITORY AND  WHEREVER PROHIBITED OR RESTRICTED BY LAW.  In addition, individuals employed by Lenovo Group Limited (the “Sponsor”), or its affiliated companies, subsidiaries, and/or its advertising and promotion agencies at any time during the Promotion Period  (collectively, “Sweepstakes Parties”), and members of their immediate family (defined as parents, spouses, children and siblings; whether biological, adopted, step or in-law) or persons living in the same household during the Promotion Period (whether related or not), are not eligible.
    
3. HOW TO ENTER: During the Entry Period, Sponsor will post an advertisement for its Lenovo ThinkPad X1 Carbon product and the Sweepstakes (the “Ad Post”) on www.x.com/lenovo (“Lenovo’s X Account”). The Ad will feature a jumping TrackPoint and a circle, and the Ad will remain on Lenovo’s X Account throughout the Entry Period.  To enter the Sweepstakes, eligible entrants must (a) go to the Ad on Lenovo’s X Account and take a screenshot of the jumping TrackPoint when it’s sitting exactly in the outlined circle (the “Screenshot”), (b) reply to the Ad Post with an upload of the Screenshot and the hashtag “#LenovoSweepstakes” (the “Hashtag”) in the comments.  An eligible Screenshot with the Hashtag, along with anything else included in the comment or submitted by the entrant, is considered an “Entry.” Eligible entrants (“Entrants”) must follow all instructions provided by Sponsor to enter. All Entries must be uploaded and received by 11:59 pm ET on December 31, 2024.  Limit one Entry per person throughout the Entry Period.  
    
4. ENTRY REQUIREMENTS: Entries must be in compliance with the following requirements, as determined in Sponsor’s sole discretion, or such Entry may be disqualified:

(a) The Screenshot must be clear and show the TrackPoint when it is within the circle.
(b) The Hashtag must be included in the same comment as the Screenshot.
(c) The Entry may not be sexually explicit or suggestive; unnecessarily violent; derogatory of any ethnicity, race, gender, religion, sexual preference, disability or age group; or profane or pornographic;
(d) The Entry may not be obscene, vulgar or offensive, or endorse any form of hate or hate group;
(e) The Entry may not promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), or promote illegal activities or any activities that may appear unsafe or dangerous;
(f) The Entry may not defame, misrepresent or contain disparaging or libelous remarks about Sponsor (or its products or services), or other people and/or companies;
(g) The Entry may not contain or use any trademarks, logos, landmarks, copyrighted materials owned by others (except for those of Sponsor that are featured in the Ad Post), or otherwise infringe or violate any third party rights, as determined by Sponsor, or contain any personally identifiable information of any individual;
(h) The Entry may not contain any images, vocal recordings, video footage, recognizable features or any personally identifiable information of any individual other than the Entrant;
(i) The Entry may not communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate.
(j) The Entry must be original and solely created by the Entrant who submits it.
(k) The Entry must not have been previously published, submitted, or otherwise used for any other commercial purpose.
(l) Any written portions of the Entry must be in English.
(m) The use of artificial intelligence is strictly prohibited.
(n) Entrant’s right to submit the Entry shall not be restricted, nor shall Sponsor’s right to use the Entry as contemplated by these Official Rules.

Any Entries containing any of the above restricted materials or any other inappropriate content may be considered ineligible and disqualified from the Sweepstakes, in Sponsor’s sole discretion.  By submitting an Entry, each Entrant agrees that his or her entry complies with these Official Rules. Each Entrant also agrees that Sponsor may disqualify the Entrant from the Sweepstakes if Sponsor believes, in its sole and absolute discretion that an Entry fails to comply with these Official Rules. If Sponsor rejects any Entry, such Entry will be disqualified and will not be considered a valid Entry. The submission of an Entry is solely the responsibility of the Entrant.  Entries may only be made according to the method described above. Automated entries (including but not limited to entries submitted using any robot, script, macro, or other automated services) are not permitted and will be disqualified.  Only Entries that meet all requirements, are obtained from eligible Entrants, and are actually received by Sponsor during the Entry Period will be eligible. I for a prize. Illegible, unintelligible, incomplete, or garbled entries will be disqualified. 

5. OWNERSHIP OF ENTRIES: By submitting an Entry, each Entrant assigns to Sponsor all ownership rights in and to the Entry submitted (including all copyrights and/or other intellectual property thereto, and all rights embodied therein) and that only Sponsor and its designees may exploit, edit, publish, use, adapt, modify, copy, disseminate or dispose of any entry, the concepts embodied therein or any elements thereof, online, in print, film, television, or in any other media for advertising and promotional purposes without compensation or notification to the Entrant of any kind, except as prohibited by law.
    
6. WINNER DETERMINATION: At 11:59 pm ET on December 31, 2024, the Entry Period will be closed in its entirety. On or about January 3, 2025, one (1) winner will be selected at random from the pool of eligible Entries (the “Potential Winner”). The Potential Winner must complete and pass the verification process set forth in Rule 8, below, in Sponsor’s sole determination, in order to be verified as the Winner and awarded the Prize. Odds of winning depend on the number of eligible Entries received.
    
7. PRIZE:
   There is one (1) prize available to be awarded in this Sweepstakes, consisting of the following (the “Prize”):

  • Lenovo ThinkPad Professional 14-inch Sleeve – ARV $39.99

The total approximate retail value (ARV) of the prize in the Prize is $3,508.99.  Only the Prize specified above will be awarded. Prize is non-transferable, with no substitutions or cash redemption available; except Sponsor reserves the right to substitute a prize or prize component of equal or greater value should a prize or any component of a prize become unavailable. Except as specifically provided herein, Prize does not include insurance, incidental charges, or any other items not specifically described in these Official Rules. All applicable taxes and usage charges on Prize are the sole responsibility of the Winner.  Taxes on the Prize are the sole responsibility of the Winner, and Sponsor may issue a Sponsor expressly disclaims any responsibility or liability for injury or loss to any Winner, any other person or property relating to the delivery and/or subsequent use of the Prize. Sponsor makes no representation or warranties concerning the appearance, safety or performance of the Prize or any portion thereof. 

8. CLAIMING PRIZE: On or about January 3, 2025, the one (1) Potential Winner will be notified via email or direct message on X (“Winner Notification”). Potential Winner has twenty-four (24) hours from the time the Winner Notification is sent to respond as directed in the Winner Notification and confirm intent to accept the Prize by providing Winner’s email address to which Sponsor can send Potential Winner an Affidavit of Eligibility and Liability/Publicity Release (where legal) (together, the “Prize Claim Forms”). Once received, the Prize Claim Forms must be completed in their entirety without modification, signed, notarized where indicated, and returned as directed to Sponsor within five (5) days. If Prize is unclaimed after first attempt at verifying a Winner, it may not be awarded.Failure to complete, sign, notarize and return the Prize Claim Forms as directed within the time frame directed will result in disqualification, and Sponsor will have the right (but not the obligation) to select an alternative potential winner at random from the remaining eligible Entries.  If an alternate is selected, he/she will be considered a Potential Winner and must complete pass the verification process with the same timing requirements in order to be verified as the Winner.  If a Potential Winner is found to be ineligible, is determined not to be in compliance with these Official Rules, declines to accept the prize, fails to return the Prize Claim Forms as directed, or does not comply with Sponsor’s instructions; or if the Winner Notification or any email or the Prize itself is returned as undeliverable, the prize may be forfeited, in Sponsor’s sole discretion. If any potential winner forfeits a prize, then Sponsor reserves the right, but not the obligation, to select an alternate. Sweepstakes Parties shall not be held responsible for any delays in awarding the Prize for any reason. The Prize will only be awarded to a verified winner. By accepting the Prize, Winner consents to Sponsor’s use of their name, photograph and/or likeness, voice, and statements made by or attributed to them (collectively, their “Likeness and Identification”), in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast and Internet), for all legitimate business purposes, including advertising and promotional activities without additional compensation, unless prohibited by law. 
    
9. MISCELLANEOUS: All Entries become the property of Sponsor and may not be acknowledged and will not be returned.  Non-conforming attempts at entry will also become the property of Sponsor and will not be returned or acknowledged.  In the event of a dispute as to the identity of an Entrant, Entry will be deemed made by the authorized account holder of the X account associated with the Entry posting.  The “authorized account holder” is defined as the natural person who is assigned the account by X.  By participating, Entrants agree to abide by and be bound by these Official Rules and by Sponsor’s decisions, which shall be final and binding with respect to all issues relating to this Sweepstakes.  It is the Entrant’s responsibility to ensure compliance with all of the conditions contained in the Official Rules. Sponsor is not responsible for any lost, late, misdirected, stolen, illegible or incomplete entries, or for any computer, online, telephone or technical malfunctions that may occur. Sweepstakes Parties are not responsible for any incorrect or inaccurate information, whether caused by website users, any of the equipment or programming associated with or utilized in the Sweepstakes, or any technical or human error which may occur in the processing of submissions in the Sweepstakes. Sweepstakes Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sweepstakes Parties are not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. Sweepstakes Parties are not responsible for any injury or damage to participants or to any computer related to or resulting from participating or downloading materials in this Sweepstakes.  If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sweepstakes Parties which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and select the Potential Winner from among all eligible Entries received prior to the event causing the cancellation.  Persons found tampering with or abusing any aspect of this Sweepstakes, or whom Sponsor believes to be causing malfunction, error, disruption or damage will be disqualified. CAUTION:  ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.  Sponsor reserves the right to correct any typographical, printing, computer programming or operator errors. 
    
10. PRIVACY: By participating in this Sweepstakes, Entrants agree to Sponsor’s use of their personal information for both online and offline direct marketing purposes. You may review Sponsor’s Privacy policy at: https://www.lenovo.com/us/en/privacy/. Your personal information may be shared with the other Sweepstakes Parties. The individual Sweepstakes Parties are solely responsible for their use of this information.
    By submitting an Entry or materials in connection with this Sweepstakes, Entrant acknowledges and agrees that Sponsor may obtain many entries or materials in connection with this Sweepstakes and/or other promotions of the Sponsor, or Sponsor or its agencies may produce materials similar to Entrant’s Entry in terms of theme, idea, format or other respects. Entrant waives any and all claims Entrant has, may have had, may have, and/or may have in the future, that any materials or works accepted, reviewed and/or used by the Sponsor may be similar to his/her entry, or that any compensation is due to Entrant in connection with such entry or other works used by Sponsor. By participating in this Sweepstakes, Entrants agree to release and hold harmless all Sweepstakes Parties, and each of their respective parent companies, affiliates, subsidiaries, officers, directors, representatives, agents and employees, from any and all liability whatsoever including for any injuries, losses or damages of any kind, either directly or indirectly, arising from or in connection with, 1) the awarding, acceptance, receipt, possession, use and/or misuse of the Prize awarded herein;  2) participation in the Sweepstakes or any related activities; (3) use of their Entry or of their Likeness and Identification, as authorized herein. 
     
11. LIMITATION OF LIABILITY, ARBITRATION AND CHOICE OF LAW: Except where prohibited by law, as a condition of participating in this Sweepstakes, Entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the Entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than Entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this Sweepstakes), and Entrant further waives all rights to have damages multiplied or increased.  All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of Entrants and Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of North Carolina, USA, without regard to conflicts of laws rules.
